Terms of Service for Omen

1. Acceptance of Terms

By accessing or using the services provided by Omen ("Omen," "we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not access or use our services.

2. Description of Service

Omen provides a Software-with-a-Service (SwaS) growth platform, including customer relationship management (CRM) software, missed-call text-back automation, review generation workflows, scheduling tools, messaging integrations, and associated setup services.

3. Subscriptions, Fees, and Payments

- Billing Cycle: Paid services are billed on a recurring monthly or annual basis as selected upon registration.

- Onboarding Fees: Setup and onboarding fees are one-time, non-refundable fees charged upon initial enrollment to cover system configuration and technical deployment.

- Payment Processing: All payments are securely processed via Stripe. By providing payment information, you authorize recurring charges to your chosen payment method until cancellation.

- Cancellation Policy: Subscriptions are month-to-month with no long-term contracts. You may cancel your subscription at any time prior to your next billing date. Cancellations take effect at the end of the current paid billing cycle. We do not provide prorated refunds for partial months.

4. Account Responsibilities & Acceptable Use

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree not to use the service to:

- Transmit unsolicited commercial messages (SPAM) or violate TCPA, CAN-SPAM, or telemarketing regulations.

- Upload, transmit, or distribute fraudulent, infringing, or harmful material.

- Interfere with or disrupt the integrity or performance of the platform.

5. SMS Messaging & TCPA Compliance

You agree that all phone numbers and contacts uploaded into your Omen account have provided prior express consent to receive communications in compliance with the Telephone Consumer Protection Act (TCPA) and applicable carrier regulations. You are solely responsible for obtaining and maintaining appropriate consent from your customers.

6. Intellectual Property

All software, designs, templates, and proprietary workflows provided by Omen remain the intellectual property of Omen. You are granted a limited, non-exclusive, non-transferable license to use the platform during your active subscription.

7. Limitation of Liability

To the maximum extent permitted by law, Omen shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities arising out of or related to your use of or inability to use the service.

8. Modifications to Service and Terms

We reserve the right to modify these Terms of Service or update service features at any time. Material updates will be posted on this page with an updated revision date
